Guy Madison's marriage was far from perfect, but the birth of his daughter Ashley brought promise. However, just four months later, his wife took Ashley with her and conceived of an Action for a Divorce that included child abuse. A Judge, without ordering any investigation, imposed limited, supervised visitation. A Separation Agreement later increased visitation. But when Guy's daughter was four, he had an argument with his ex--and 15 minutes later her sister called in charges to Child Protective Services (CPS) that stripped Guy of visitation. Thus began Guy's Hellish odyssey of defending himself to Family Court, Court-appointed therapists and CPS caseworkers. A history followed of Guy getting visitation back, only to be thwarted by further accusations. Starting at the age of ten, Guy was no longer allowed to see his daughter--unless she wanted to. Unfortunately, she was brainwashed well by then. Guy continued his fight until Ashley was 18, no longer a minor. A "decision of interest" was made then that was published in his State's Law Journal. But it was too late for Guy and Ashley, their relationship ruined by false charges and the people who entertained them. Fighting for a Daughter is a true story that will frighten any parent. It is the culmination of the author's notes, CPS documents, and Court transcripts that span a quarter century.

`False words are not only evil in themselves, but they infect the soul with evil.' Plato
By Grady Harp
Guy Madison's book `FIGHTING FOR A DAUGHTER: A Father's Journal of Battling False Abuse Charges in `Family' Court' is a hefty volume that not only spells out one of the more tragic instances of a father being refused the right to grow up with his daughter because of lies of abuse and sexual assault trumped up by his wife and her sister, but it also is a study of why marriages fail, why the systems meant to protect us form such falsified allegations so often fail, and why the court system is fallible as are the child protection societies and agencies.
The book is very long - intentionally so as Madison elected to include interview transcripts and court records and other documents to make his case - and the writing tends to bog down in loathing and disgust and becomes trying to stay with the book.
But then this is a true story, told precisely as it happened, and because of that it needs to be included in the law school libraries and Social Studies department where social workers are trained in dealing with child protection and child custody issues. There is harrowing truth here that we all should acknowledge in hopes of helping parents in the position of Guy Madison's trauma.
This book is also about the persistence, the essence of fatherly love, and the eventual triumph of a man so devoted to both his daughter and to justice that he stays with this nightmare until it becomes a resolved piece of history. One cannot come away form this book without a sense of admiration for the author and praise for his courageous sharing of a problem that unfortunately is not a unique one in our society. `It is not the lie that passeth through the mind, but the lie that sinketh in, and settleth in it, that doth the hurt.' Francis Bacon. Grady Harp, May 15

based on a love which endures despite marital failures

This is a story that reveals the weaknesses built into the Family Court System where, through time and exposure, those responsible for preserving the sanctity of children's familial relations, stop paying close attention, stop caring about getting it right and often just "phone it in." The tragedy of this is that parents and children lose the right to the beauty of the parent-child relationship; based on a love which endures despite marital failures. Here, the manipulation of the system and the young child by an admittedly mentally unbalanced mother, who accused the father of sexually molesting his young female daughter is a study in self-serving evil to the exclusion of the even the well being of the child.
Fearful that her significant physical impairments, which necessitated almost yearly multi-month hospitalizations, might call into question her fitness to raise her infant daughter upon the break up of her marriage, Liz fabricate allegations of sexual impropriety against her husband in the divorce papers. With no inquiry into their validity, the court restricts Guy's visits with 4 month old Ashley to weekly supervised visits. Despite the results of in depth investigation into the charges negating their validity, the court doesnt grant reasonable visitation to Guy. It appears no one, save Guy, seemed to care. Until the child was four all visits were supervised. No amount of refutation of the sexual misconduct allegations seemed to persuade the court that regular visitation should be granted Guy. It was only upon a settlement that alternate weekend visits were established when she was 4.
At that point, the mother's family started working on the child, essentially telling her that the father must have touched her vagina. Though they made other claims, the child would only ever mimic that the father "touched me there." There was no detail, no upset on the part of the child, no behavior consistent with abuse by the child and multiple experts concluded that no sexual abuse occurred. In fact no one ever even learned from the child under what circumstances he touched her. Did he help her in the bathroom, dress her, lift her up by her legs? The child would never explain despite repeated inquiries. However, the court allowed the apparent and repeated maligning of the father to the child by the mother, her sister, her mother and other family members. Despite all the warning signs of intentional parental alientation, the mother was never penalized by the court. Thus, she was able to maintain custody and work on alienating the child from her father so he could never challenge custody. By the time the child was ten, she'd been told repeatedly that her father (oft referred to as the child molester) sexually molested her when she was younger, left them in poverty because he refused to give them any money (despite regular payment of court ordered support plus therapy payments), that the father harassed the mother by taking her to court, that the father was the reason she had to go to 'court ordered' therapy even though the mother (against the advises of all of the experts and the judge) did not think there was any reason for it, that the father physically abused the mother when they were married (another fiction), that Guy did not care about Ashley or LIz, that Guy wanted to take Ashley away from Liz so she wouldn't see her anymore, and, that since he had a new baby with his new wife, he didn't need Ashley anymore and didn't want to see her. Against this history, at 10 years old, the child, who had been an integral part of the father's new family including his wife's extended family,
Ashley decided not to speak to the father anymore.
The next 7 years were a study in too little too late. The court adjourned the matter for many months at a time despite the crisis of daughter having no interaction with the father and then at appearances made no real demands upon the mother to present the child for visitation with the father. The child refused repeatedly to articulate a single reason for her refusal to see the father; calling it a secret and promising to tell "next time" and then refusing again. This child, who knew too well that she was used as a pawn in the struggle between her parents, determined to participate in the manipulation and she became the star in a drama where at 10 she was given the power to decide custody.
She would tell the mother she did not want to see, speak to the father; the mother would allow it, fail to produce her in court. The court would verbally admonish, adjourn for lengthy periods and essentially allow the cycle to continue. At 10, the relationship could have been mended with real help from the system and the court appointed experts. The lack of effective action for a period of 4-5 years despite the father's every effort, made it impossible to remedy during the child's minority. The isolation from the father coupled with the regular poisonous commentary about Guy perfected the parental alienattion the maternal family had been working on for 14 years.
With heartbreaking steadfastness, Guy Madison maintained his efforts even after it seems they were making an eventual reconciliation less likely. It was only in her adulthood, after Ashley, who's mom committed suicide when she was 13, broke from her aunt who had become her guardian and the most aggressive maligner of Guy, did Ashley begin to understand what had been done to her and her father. She reached out and in her 20's reconciled with her dad.
This book should be read by everyone participating in the Family Court as a reminder that what they are doing effects lives at the most basic level. When you stop caring about the people involved and the work becomes a job for a paycheck, GET OUT and work somewhere else. It is too important to allow cynisism and overwhelm to set in.
